Thomas Ross has been identified as the victim. Eight-year-old Blasdell, New York resident Thomas “Tommy” Ross passed away, according to Hamburg Police reports, while a four-year-old passenger received medical attention at the hospital and was later released. When Blasdell resident Heather Van Elk, 35, stopped to make a left turn onto North Creek Road while driving east on Route 5, she was reportedly struck from behind by a car belonging to Angola resident Markus Genovese, 52.
Genovese allegedly ran from the scene but was later discovered hiding in a backyard not far away. After being transported to ECMC, he was charged with driving under the influence of alcohol, driving under the influence of drugs and alcohol combined, first- and second-degree vehicular manslaughter, felony aggravated unlicensed operation of a motor vehicle, fleeing the scene of a fatal auto accident, and other moving violations. Genovese is being jailed without bond pending a felony hearing on June 13. On Saturday night, the road was closed for a number of hours before opening again.
