LOUISVILLE, Ky. (WDRB) — A judge denied to grant the early release of a former University of Kentucky student who called a Black student racial slurs and attacked her in 2022, LEX18 reported Wednesday.
Sophia Rosing, 24, pleaded guilty in August to four counts of fourth-degree assault, one count of disorderly conduct and public intoxication. Rosing, who is white, was caught on video shouting racial slurs and hitting a Black student employee at a residence hall. She was sentenced to 12 months in jail, ordered to perform 100 hours of community service and pay a $25 fine.
Earlier this month, her attorney asked a Fayette County judge to grant her “shock probation,” which allows low-risk offenders to be released between 30-180 days of their conviction, claiming they’ve been essentially “shocked straight” by their incarceration and are no longer a threat to the community.
Rosing has served about four months in jail.
The judge’s order Wednesday concluded shock probation, “would unduly depreciate the seriousness of the offenses and accordingly denies the Motion for Shock Probation.”
Rosing’s attorney, Daniel Whitley, wrote in a motion that Rosing has “already suffered tremendous personal and professional consequences,” including expulsion from UK and national criticism.
While acknowledging that she needs to face accountability, Whitley argued that her continued incarceration “will not serve the best interest of justice, nor will it contribute to her rehabilitation.”
Whitley requested Rosing be able to “continue her growth outside of a jail cell” under strict probationary supervision which would include counseling, substance abuse education, racial sensitivity training, anger management counseling and community service.
A video of Rosing went viral in November 2022 as she stumbled into a dorm where Kylah Spring was working an overnight shift.
Spring has said when a student appears drunk, she is required to call a resident advisor to report it. But while waiting on an resident adviser, Spring said Rosing hit her and tried to run her over with a grocery cart in the lobby.
An officer arrested Rosing as she repeated the offensive language in front of other students.
In her motion for early release, Whitley said Rosing’s actions were “clouded by excessive drinking, she lost control, directing unprovoked aggression and offensive language toward fellow student Kylah Spring.
“The incident, captured on video and shared nationwide, was more than just a misstep, it was a profound failure in judgement, one she deeply regrets and wishes she could undo.”
From the moment she sobered up, Rosing was “horrified” by what she had done and acknowledges there is “no excuse for what she did,” according to the motion.
Since the attack, Rosing has taken full responsibility, publicly apologized and committed to personal growth and accountability, the motion said.
A hearing date has not been set. Prosecutors have not yet responded to the motion.
